Terms and conditions

1) Scope

1.1 These Terms and Conditions ("T&Cs") of Maymia (www.may-mia.com) apply to all contracts concluded between a consumer or business customer (hereinafter "Customer") and Maymia (hereinafter "Seller") regarding the sale and delivery of goods presented in the Seller’s online shop.

1.2 These T&Cs also apply to voucher purchases, unless stated otherwise.

1.3 A "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly not related to their trade, business, or profession. A "business customer" is any legal or natural person or partnership acting in their professional or commercial capacity.


2) Conclusion of Contract

2.1 Product listings in the Seller's online shop do not constitute legally binding offers but serve as an invitation to submit an order.

2.2 The Customer can submit a binding offer using the online order form integrated into the shop. After placing products in the virtual shopping cart and completing the checkout process, the Customer submits a legally binding offer by clicking the final confirmation button.

2.3 The Seller may accept the Customer’s offer within five days:

  • by sending a written or electronic (e.g., email) order confirmation;

  • by dispatching the ordered goods;

  • by requesting payment from the Customer after order placement.

If multiple of these options apply, the contract is concluded at the moment one of them first occurs. If the Seller does not respond within five days, the offer is considered declined.

2.4 When choosing the payment method “PayPal Express,” payment processing is handled by PayPal. The contract is concluded upon clicking the order confirmation button which simultaneously triggers the PayPal transaction.

2.5 The contract text will be stored by the Seller and sent to the Customer in text form (email or letter) after the order has been placed. If the Customer has a registered account, order data can be reviewed in the Customer account.

2.6 Before finalizing an order, the Customer can detect and correct input errors. Zoom functions and review steps in the checkout process can help ensure accuracy.

2.7 Contracts can only be concluded in the German language.

2.8 Order processing and communication generally take place via email. The Customer is responsible for ensuring the correctness and accessibility of the provided email address.


3) Right of Withdrawal

3.1 Consumers generally have the right to withdraw from the contract.

3.2 Details are provided in the Seller’s separate cancellation policy.


4) Prices and Payment

4.1 All prices include VAT. Any additional delivery or shipping costs are listed separately.

4.2 Payment methods are specified during the checkout process.

4.3 Payments via PayPal are subject to PayPal's user agreement.

4.4 Payments via Shopify Payments are handled by Shopify International Limited and may involve other service providers.


5) Delivery and Shipping

5.1 Goods are delivered to the shipping address provided during checkout.

5.2 If a delivery fails and is returned to the Seller due to reasons within the Customer’s control, the Customer must cover the return and original shipping costs.

5.3 If local pickup is available, the Seller will notify the Customer by email. No shipping fees apply to self-collection.

5.4 Vouchers are delivered by email, postal mail, or digital download.


6) Retention of Title

The Seller retains ownership of the goods until full payment is received.


7) Warranty

7.1 Statutory warranty rights apply for defective products.

7.2 The Customer is encouraged to inspect goods upon receipt and notify the Seller of any visible damages. This does not affect legal warranty rights.


8) Promotional Vouchers

8.1 Promo vouchers issued free of charge can only be redeemed within the specified validity period and in the Seller’s online shop.

8.2 Certain items may be excluded as stated on the voucher.

8.3 Vouchers must be redeemed before order completion. Retroactive application is not possible.

8.4 Only one promo voucher per order.

8.5 Order value must meet or exceed voucher value. No cash refund for remaining credit.

8.6 Any remaining balance must be paid using another payment method.

8.7 Promo vouchers cannot be paid out or earn interest.

8.8 If items paid for with a promo voucher are returned, the voucher will not be reissued.

8.9 Promo vouchers are transferable.


9) Gift Vouchers

9.1 Gift vouchers purchased via the online shop can only be redeemed there.

9.2 Vouchers are valid until the end of the third calendar year following purchase.

9.3 Vouchers must be applied before order completion.

9.4 Multiple gift vouchers may be used per order.

9.5 Gift vouchers cannot be used to purchase other vouchers.

9.6 If the order value exceeds the voucher, remaining balance can be paid using other methods.

9.7 Gift vouchers are not redeemable for cash or interest-bearing.

9.8 Gift vouchers are transferable.


10) Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This does not affect any applicable consumer protection rights under the law of the consumer’s country of residence.


11) Jurisdiction

If the Customer is a business, exclusive jurisdiction lies with the Seller’s business location. This also applies to international business transactions.


12) Alternative Dispute Resolution

12.1 The EU Commission provides an Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

12.2 The Seller is not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.
